Montgomery Personal Injury Attorney

Unfortunately, personal injuries happen every day in the U.S., causing physical pain, emotional distress, and financial worries. These injuries are commonly the result of accidents caused by negligent parties, such as careless drivers, defective product manufacturers, and remiss property owners. Personal injury victims may have their lives disrupted for weeks, months, or years, depending on the extent of the physical damage inflicted.

They commonly are temporarily disabled, unable to work, hospitalized, require extensive outpatient treatment, and face the stress of medical bills, out-of-pocket expenses, loss of income, and more. In the worst cases, they are permanently disabled or die of injuries, leaving shocked and grieving families behind, often stripped of the income they depended on.

Alabama Personal Injury Law

Fortunately, personal injury and wrongful death laws have been established to compensate these victims and their families. At Sawyer Law Firm, Montgomery personal injury attorney J.P. Sawyer provides compassionate representation to those who have sustained injuries due to the wrongdoing of others. We understand the difficulties you face and will aggressively pursue the financial compensation you need and deserve to recover and move forward in life. We are backed by more than 25 years of experience in seeking maximum compensation for victims through negotiated settlements or litigation.

When such incidents occur, personal injury law allows you to seek compensation for your losses and damages, such as past and future injury-related medical expenses, lost wages or income, pain and suffering, property damage, and emotional trauma.

This is generally pursued in a claim or lawsuit against the at-fault party’s insurance company. It is a well-known fact that insurance companies are not on your side and will commonly do everything possible to minimize, delay, or deny the compensation to which you are entitled. That is why you need an attorney who knows how to fight their tactics to help you obtain a fair and just result.

Montgomery car accident lawyer J.P. Sawyer represents individuals and their families who have been injured or killed as a result of the negligence, carelessness, or recklessness of others in car wrecks.

When To Hire a Car Accident Lawyer

As a general guideline, it’s best to contact a lawyer after sustaining injuries in a car accident as soon as possible. There are a couple of reasons for this, the first being the statute of limitations. The statute of limitations is a law implemented on a state-by-state basis that outlines when an injury victim can file a personal injury claim. According to the Code of Alabama section 6-2-38 the state of Alabama has a two-year timeline. More specifically, this means you have two years to file your or you will lose your chance to file and pursue compensation.

While rare, there are some exceptions to this law where the filing time may change, including:

  • If the injury victim is under the age of 19 at the time of the accident

  • The negligent party left the state of Alabama before a claim could be filed

Beyond the statute of limitations, which applies to all personal injury claims, car accident injuries are unique in that they are most usually soft tissue injuries. Soft tissue injuries are injuries that affect the tendons, ligaments, and muscles, such as whiplash. Like whiplash, these injuries progressively get worse over a few days or even weeks after the injury occurred.

Because of this, many injury victims sign a compensation agreement with an insurance company before talking to a lawyer only to discover after that their injuries are worse than they initially believed. The majority of people in this situation are not able to recover any additional compensation to cover their additional costs after signing a compensation agreement. Medical Malpractice Lawyers in Montgomery, AL

Proven Attorneys Representing Victims in Alabama for 25+ Years

Medical negligence is the third leading cause of death in the U.S. behind heart disease and cancer, according to the Journal of the American Medical Association. Healthcare professionals who provide care that is below generally accepted standards should be held responsible. However, proving negligence is not always easy. This is how a Montgomery medical malpractice attorney can help you!

Alabama Medical Malpractice Statute of Limitations

Each state can impose different laws that govern medical malpractice cases, one of which is the statute of limitations. In Alabama, the statute of limitation to file a medical malpractice claim is two years. This means you have two years from the date of your injury to file a claim or you may lose your right to compensation. There are three main exceptions: discovery, minors, and statute of repose.

Discovery Rule

If an injury victim does not realize they have an injury or did not know that malpractice took place they have six months from the date of this discovery to file a claim. To qualify for this exception you must not have been able to reasonably know that you had a medical malpractice claim within the two years standard statute of limitations.

Statute of Limitations for Minors

If a child is under the age of four when malpractice occurred they have up until their eighth birthday to file a lawsuit.

Statute of Repose

The statute of repose states that all medical malpractice claims in Alabama must be filed within four years of the malpractice. The statute of repose overrides the discovery rule, meaning that regardless of when you discovered any malpractice if it was more than four years from the date of injury you are not eligible to file a claim. The statute of repose doesn’t override the exceptions for minors under the age of four.

Medication Errors

Even drugs that are generally safe for mass consumption can cause damage if prescribed incorrectly. If your doctor or pharmacist provides you with the wrong drug or fails to notice that a drug they prescribed is harming you, they could be liable for a medication error lawsuit.

Medication errors are surprisingly common, with the Institute of Medicine estimating that at least one medication error is made every day in every hospital. The error could be the result of a doctor’s illegible handwriting, failure to instruct patients on the proper dosage of medication, or pharmacists erroneously filling prescriptions with similar-sounding drugs. No matter the cause, you should speak to an attorney any time you or a loved one has been injured from a medication error.
